DELHI HIGH COURT ON MATRIMONIAL PROPERTY: CAN A MOTHER-IN-LAW BE FORCED OUT OF HER OWN HOME?

A matrimonial dispute was already going on.

Then the question became much more complicated:

Who should live in the Delhi property?

In Maya Jain v. Dimple Jain & Anr., decided by the Delhi High Court on 7 January 2026, the dispute concerned a property at Ram Nagar, Krishna Nagar, Delhi.

The petitioner was the mother-in-law of the respondent. She invoked the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking eviction of the daughter-in-law from the property. The record states that matrimonial litigation between the couple had already commenced.

THE POINT OF THE JUDGMENT

The Delhi High Court took a balancing approach.

The Court observed that the admitted owner of the property could not be compelled to live at the mercy of others while the daughter-in-law alone enjoyed the property.

At the same time, the Court recognized that the daughter-in-law was entitled to respectable accommodation.

The solution was not simply to declare one side the winner.

The Court modified the arrangement and fixed ₹15,000 per month as rental accommodation, giving the daughter-in-law time to find suitable alternative accommodation. The Court also directed that the disputed property could not be alienated or subjected to third-party rights without the Court's permission.

WHY THIS JUDGMENT MATTERS IN REAL-LIFE PROPERTY DISPUTES

This is where matrimonial litigation can become a property problem.

A husband may think:

“The dispute is between me and my wife.”

But the litigation may involve:

mother's property,

matrimonial residence,

daughter-in-law's accommodation,

senior-citizen rights,

and ongoing matrimonial proceedings.

The title documents and ownership position therefore matter enormously.

The judgment also demonstrates something important: a property dispute arising alongside matrimonial discord may require balancing competing rights, rather than assuming that one person's matrimonial relationship automatically settles the question of ownership or possession.
