Divorce Lawyers in Delhi NCR: Jewellery Legal Issue?
In Harcharanjeet Bains v. State & Anr., decided on 16 September 2026, the petitioner was a US-resident medical practitioner who had been living in the United States since 1995.
The wife alleged, among other things, non-return of jewellery.
According to the complaint itself, the jewellery had been handed over to the husband's sister-in-law to be kept in her locker.
The Delhi High Court therefore found that the necessary ingredients of criminal breach of trust under Section 406 IPC were not made out against the husband merely from the matrimonial relationship.
The Court quashed the Section 406 proceedings against him.
The Court did not quash the entire criminal case.
The proceedings under Section 498A read with Section 34 IPC were allowed to continue, because the allegations under those provisions raised factual issues that required examination at the appropriate stage. The Court expressly said that its ruling should not be treated as a finding that the remaining allegations had been proved.
The husband had been residing in the United States for many years, and the Court examined the limitation argument in light of the statutory provisions concerning an accused's absence from India. The Court did not treat the limitation objection as automatically sufficient to terminate the remaining prosecution.
So if you are an NRI husband facing a Delhi matrimonial dispute, don't simply collect every document under one heading called “false case”.
Separate each allegation.
Jewellery
क्या bank, locker, bills or other documentary evidence exists?
And अगर आप divorce lawyers in Delhi या divorce lawyers in Delhi NCR search कर रहे हैं, तो notice/FIR के हर section को उसके अलग legal ingredients के against समझना जरूरी है.

This post discusses one Delhi High Court judgment. The ruling was specific to the allegations and evidence in that case; it does not mean that every Section 406 or 498A allegation against a husband will be quashed.
