NRI PURUSH AAYOG : Delhi में CAW Cell और matrimonial case में advocate की handling पर doubt हो तो क्या करें - What Should Men Do If They Doubt Their Lawyer’s Case Handling?

CAW CELL DELHI | MenCell.Org Delhi: Advocate ने Written Statement ही file नहीं किया तो Divorce Case का क्या होगा?

You trusted your advocate.

You gave the documents.

You paid the fee.

You assumed the case was moving.

लेकिन Court में एक basic procedural step ही properly नहीं हुआ — Written Statement file नहीं हुआ.

And then one day you discover that the matrimonial case has gone ex-parte.

This is not a fictional fear.

The Delhi High Court recently dealt with exactly this kind of professional failure in Pratibha Verma v. Abhishek Kumar, MAT.APP.(F.C.) 56/2024, decided on 29 May 2026.

The wife had been served with the divorce petition and had engaged a lawyer. Her counsel entered appearance on 17 December 2019 and sought time to file the written statement.

But the record showed that during several dates in 2021–22, appearance continued through counsel/proxy counsel, while the written statement was still not filed despite repeated opportunities and costs.

Eventually, because of non-appearance, the Family Court proceeded ex-parte on 6 April 2022.

Then, on 3 August 2022, the marriage was dissolved by an ex-parte decree.

Stop here for a moment.

A person may believe that “my advocate is handling everything” — while the Court record may be telling a completely different story.

That is the dangerous gap.

The Delhi High Court recorded that the litigant had specifically complained about lack of proper assistance from the earlier counsel, alongside serious financial hardship and the extraordinary disruption during the COVID period. The Court also noted that she had entrusted the matter to counsel who had been appearing on her behalf.

And then came an important judicial finding.

The High Court held that a litigant should not ordinarily be penalised for the lapse, negligence or non-diligence of counsel, where the circumstances demonstrate sufficient cause. It set aside the Family Court's order, also set aside the ex-parte divorce decree and sent the matter back for adjudication on merits.

यहाँ एक बात बहुत seriously समझने वाली है.

Court case सिर्फ advocate के भरोसे छोड़ देना और फिर dates, orders और filings check न करना dangerous हो सकता है.

You should know:

What was filed?
What was not filed?
What happened on the last date?
Was any cost imposed?
Was your right closed?
Was an ex-parte order passed?
What is the next date?

Because “advocate देख रहे हैं” is not the same thing as the Court record actually being protected.

And Delhi High Court has separately cautioned, in another matrimonial appeal, about a proxy counsel appearing without knowing the facts or even the steps required to complete service. The Court said a counsel entering appearance should at least know the prima facie case and stage of proceedings and should read the file before appearing.

So the issue is bigger than one missed hearing.

Preparation matters.
File-reading matters.
Procedural compliance matters.
Date monitoring matters.
Written pleadings matter.
Court orders matter.

एक छोटी procedural lapse कभी-कभी बड़ी litigation problem बन सकती है.

For a husband or family already dealing with CAW CELL DELHI, CAW Cell Nanakpura, Crime (Women) Cell, matrimonial complaint, 498A/406 allegations, DV proceedings or divorce litigation, this is why an independent review of the actual case record can be important.

Don't simply ask your lawyer, “Case kaisa chal raha hai?”

Ask for the record.

Ask what happened.

Ask what was filed.

Ask what the Court ordered.

Ask what must be done before the next date.

And if something doesn't match what you were told, don't keep waiting month after month hoping it will somehow correct itself.

That delay can become costly.

Through MenCell.Org, built over nearly two decades, I work through judicial activism, RTI activism and other lawful methods where appropriate, with a practical focus on examining procedural problems, reconstructing what has actually happened and developing a case strategy for husbands and families.

My approach is not merely to hear the story and give general reassurance. The actual Court record, orders, pleadings, procedural history and available evidence need to be examined before deciding the next lawful step.

If you are facing CAW CELL DELHI, matrimonial FIR, 498A/406 allegations, divorce proceedings, DV proceedings or a case where you suspect that your advocate has not properly handled filings or dates, don't wait until an ex-parte order or another irreversible procedural development forces you to discover the problem.

Case-specific caution: Pratibha Verma v. Abhishek Kumar was decided on its particular facts, including the litigant's circumstances during the COVID period, financial hardship, counsel's handling of the proceedings and the resulting ex-parte decree. The judgment does not mean that every missed hearing, non-filing or advocate-client dispute will automatically result in restoration of a case. The actual orders, delay, explanation and surrounding facts must be examined carefully.
